A registered trademark in India is valid for ten years, counted from the date of application. Unlike company compliance, there is no yearly filing, which is exactly why many owners forget the renewal and risk losing their brand protection.
| Stage | Window | Government fee (e-filing, per class) |
|---|---|---|
| Early / on-time renewal | Up to 1 year before expiry | Rs 9,000 |
| Grace period with surcharge | Within 6 months after expiry | Rs 9,000 + Rs 4,500 surcharge |
| Restoration of removed mark | Within 1 year after expiry | Renewal fee plus restoration fee |
Physical filing costs more than e-filing. Fees are per class, so a mark registered in three classes pays three times.

Q1. How long is a trademark valid in India?
Ten years from the date of application, and it can be renewed every ten years indefinitely.
Q2. How early can I renew?
Renewal can be filed up to one year before the expiry date.
Q3. What if I forget to renew?
You get a six-month grace period after expiry with a surcharge. After that, the mark is removed, but it can still be restored within a year by paying a restoration fee.
Q4. Can I change the logo while renewing?
No. Renewal keeps the mark as registered. A modified logo usually needs a fresh application.
